Hughes loses appeal in code violations case

The court of appeals has upheld the infraction convictions against Marvin “Butch” Hughes of Hastings for violating city codes at the former middle school, 505 N. Hastings Ave.

The Nebraska Court of Appeals issued an opinion Tuesday affirming a previous order by Adams County District Court Judge Terri Harder, on May 2, 2013, upholding Hughes’ conviction in county court.

Less than a month earlier, Adams County Judge Michael Offner found Hughes guilty of 21 code violations after a trial April 13, 2012. Offner sentenced Hughes to $2,100 in fines. The infractions included two counts of non-compliance with building code, three electric code violations, four fire code violations and 12 counts of failing to obtain a building permit.

Hughes asked the appellate court to find that the district court erred by affirming the six county court decisions.
