Heart attack stops trial

Adams County Public Defender Art Toogood had a heart attack this weekend and was taken to the Nebraska Heart Institute & Heart Hospital in Lincoln.

Toogood's absence in court this morning forced Adams County District Judge Stephen Illingworth to declare a mistrial in the case against John A. Espino, 30, of 1215 N. Lexington Ave., who has been accused of striking his pregnant girlfriend in the stomach with a board on Aug. 13, 2011.

The trial started Thursday and was scheduled to conclude today.

Deputy Public Defender Sam Zeleski told the court and jury this morning that Toogood had had a heart attack Sunday.

A spokesman at the hospital confirmed that Toogood is a patient there, but the family didn't wish to release any information about his condition.
