Water lawsuit dismissed

A legal cloud hanging over a major Republican River Basin streamflow augmentation project in southwestern Nebraska appeared to lift Tuesday as a federal district judge dismissed a lawsuit filed against it.

Judge Joseph A. Bataillon dismissed the lawsuit filed in December 2012 against the Nebraska Cooperative Republican Platte Enhancement Project, or N-CORPE — a project now under construction that will allow for the pumping of groundwater to the Republican and Platte River basins in times of difficulty.

The lawsuit seeking to stop the project had been filed by the Frenchman-Cambridge and Nebraska Bostwjck irrigation districts, along with three individual directors of the Frenchman-Cambridge District, against the N-CORPE interlocal entity; the Upper Republican Natural Resources District, which spearheaded the N-CORPE project from the beginning; and various state and federal officials and agencies. Motions to dismiss the case were filed in early March.
